Make Sure You're Not Just Another
Real Estate Commission or Retainer!
Unfortunately, we chat with numerous homeowners that may not be receiving the best possible representation by their Real Estate Broker, Agent or possibly even their Lawyer.  Here are a couple of comments that have been shared with us in the past week:

"My Realtor, he said that out of 200 Short Sales, 99.9% have never gone after the deficiency."

If your agent claims that they have closed 200+ Short Sales, please contact us.  Provide us with their name and real estate license number and we will gladly qualify their statementSecondly, do not rely on the opinion of a Broker or Agent as it relates to deficiency implications.  And if you do seek a lawyer opinion - make sure he/she is qualified in the area of Real Estate Law.

"My real estate lawyer says the bank can come after me if I short sale, but not for foreclosure"

- Los Angeles County, CA

Based on the limited information provided by the homeowner, they only have their original purchase loan with their lender.  Under these circumstances, this homeowner may fall under the protection of the 2007 Mortgage Debt Forgiveness Act.  A Short Sale is less impactful than Foreclosure.  Note:  We don't claim to know all of this homeowners circumstances - and we always recommend that homeowners consult with their tax preparer and/or lawyer regarding potential deficiency implications.

"My real estate agent told me that they could sell my house a lot faster if it was vacant... So, I rented an apartment and moved out."

*  This was completely unnecessary and scenario is more likely the work of an agent that is not familiar with the Short Sale process.  In the end, the homeowner is the one that will suffer.  The Short Sale transaction can take 4 to 6 months - and the homeowner can continue to live in the home and (in most cases) will not be required to make their mortgage payment throughout the course of the Short Sale process.  In addition, the Lender prefers to have the property occupied by the homeowner.  

Overview:
Do not take the word of your broker and/or agent when making a final determination relating to potential deficiency balance or deficiency judgment.  Their opinion is just that (their opinion)... Do not accept their opinion as that of a Legal or Tax Preparer professional.
